FIR Registered in Diglipur After Minor Found to Have Consumed Alcohol

Police in Diglipur have registered a case against two young men after a minor girl was found having consumed beer during Durga Puja festivities.

As per the First Information Report (FIR), the girl, a school student, had gone to see the Durga Puja Celebrations in Diglipur on the evening of October 1, accompanied by her sister-in-law, her sister-in-law’s brother, and another neighbour. Later in the evening, she remained in the company of the two young men — whom she referred to as“brothers” — while her sister-in-law got busy with the festivities. During this time, she expressed curiosity and tried beer for the first time.

Police patrolling the area noticed the smell of alcohol and, considering her age, took her to the Community Health Centre for medical examination. She was later found to be safe and confirmed in her statement that no harm or wrongdoing was done to her. She said she had voluntarily sipped beer for the first time and was unable to handle it.

Despite this, police have registered an FIR as the law strictly prohibits the supply of alcohol or intoxicants to minors, even if offered casually or consumed voluntarily.

The FIR lists the following legal provisions:

  • Section 77 of the Juvenile Justice (Care & Protection of Children) Act, 2015 — which penalises giving intoxicating liquor, narcotic drugs or psychotropic substances to a child (punishable with rigorous imprisonment of up to seven years and a fine of up to ₹1 lakh).
  • Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 — a general-explanation provision applying the doctrine of common intention. It means that if an offence is committed in furtherance of a shared plan, each person who shared that intention can be held liable as if they had acted alone.
