Disputes between house owners and tenants, a persistent issue across the country, have also been prevalent in the Andaman and Nicobar Islands. To address these concerns and provide legal protection for both parties, the Parliament enacted the Andaman & Nicobar Islands Tenancy Regulation, 2023.
The regulation, promulgated by the Hon’ble President of India, was officially notified on November 24, 2023, through Notification No. CG-DL-E-24112023-250253. Designed as a comprehensive framework, the regulation aims to safeguard the rights and responsibilities of house owners and tenants alike, promoting harmonious tenancy practices in the islands.
However, despite 11 months having passed since its promulgation, the regulation remains non-operational. According to sources, the delay is attributed to the absence of a requisite Gazette Notification from the Andaman & Nicobar Administration to frame and issue rules necessary for its implementation. This has left the intended protections and benefits inaccessible to the island’s residents.
Hon’ble Member of Parliament, Mr. Bishnu Pada Ray, has raised this issue after being approached by several concerned citizens. In a letter to the Hon’ble Lieutenant Governor, Mr. Ray has urged the Administration to expedite the process of framing and notifying the rules to operationalise the Tenancy Regulation at the earliest.
The MP highlighted the urgency of resolving tenancy disputes and providing a legal framework that ensures fairness and clarity for all parties involved. The Andaman & Nicobar Islands Tenancy Regulation, 2023, if implemented, could significantly enhance the rental ecosystem in the region.
Residents now await swift action from the Administration to unlock the potential of this vital legislation.
